Privacy Notice

1. Introduction

This Privacy Notice is issued by Federlite Sdn Bhd, trading as Felton ("Felton", "we", "us" or "our"), in accordance with the Personal Data Protection Act 2010 of Malaysia ("PDPA"). It explains how we collect, use, process, disclose, retain and protect personal data and other information relating to visitors of the website located at felton.com.my, including all of its pages and sub-pages (the "Website"), and to persons who contact us through the Website, by telephone, by e-mail or by WhatsApp. By accessing or using the Website, or by submitting any information to us, you acknowledge that you have read and understood this Privacy Notice and consent to the processing of your information as described in it.

2. Personal data you provide to us

When you send an enquiry or request a quotation through the Website, we collect the information you choose to provide, which may include your name, telephone number, e-mail address, the products, product codes, colours, sizes and quantities you enquire about, and the page from which the enquiry was made. Where you continue the conversation with us on WhatsApp, by telephone or by e-mail, we will also receive the content of those communications, together with any information you provide in them, such as delivery addresses, company details and order requirements. You are not obliged to provide any personal data to us; however, if you do not, we may be unable to respond to your enquiry, provide a quotation or supply products to you.

You are responsible for ensuring that the information you provide is true, accurate, complete and your own. If you provide the personal data of another person, you confirm that you have obtained that person's consent to its disclosure to us and its processing in accordance with this Privacy Notice. By submitting an enquiry, you consent to being contacted by us by WhatsApp, telephone, SMS or e-mail in relation to your enquiry, and with information about our products, promotions and services, until you tell us otherwise.

3. Information collected automatically

When you visit the Website, certain information is collected automatically, either by us or by the third-party service providers described in Section 4. This information may include:

  1. technical information such as your device type, browser type and version, operating system, screen size, language setting, approximate location derived from your IP address, and the date and time of your visit;
  2. information about how you use the Website, including the pages and products you view, the order in which you view them, how far you scroll, the length of time during which you actively view a page, the buttons, links, images and options you select, the steps you take within the enquiry form, and the manner in which you leave a page or close the enquiry form. We record that information has been typed into a form field, but we do not record the content of what you type through this method;
  3. the website, search engine or advertisement that referred you to the Website, including advertising click identifiers attached to the link you followed; and
  4. a random visitor identifier stored in a cookie on your device, which allows visits from the same device to be associated with each other and with an enquiry made from that device. This identifier does not by itself contain your name, telephone number or e-mail address.

Visits made by our own staff are identified separately and are excluded from our statistics.

4. Third-party services

We use the following third-party services, each of which may collect information from your device through cookies, pixels, scripts or similar technologies and process it in accordance with its own privacy policy:

  1. Microsoft Clarity. We partner with Microsoft Clarity to capture how you use and interact with the Website through behavioural metrics, heatmaps and session replay, in order to improve the Website. Website usage data is captured using first-party and third-party cookies and other tracking technologies. Clarity is configured to mask text that you type. For more information about how Microsoft collects and uses your data, please refer to the Microsoft Privacy Statement at privacy.microsoft.com/privacystatement;
  2. Google Analytics, Google Ads and Google Tag Manager (Google LLC), used to compile visitor statistics and to measure the performance of our advertisements;
  3. Meta Pixel (Meta Platforms, Inc.), used to measure the performance of our advertisements on Facebook and Instagram; and
  4. TikTok (TikTok Pte. Ltd. and its affiliates), used to measure the performance of our advertisements on TikTok.

Where you arrive at the Website from an advertisement and subsequently make an enquiry or purchase, we may report the related advertising click identifier, the type of action and its value to the relevant advertising platform, so that the platform can attribute the result to the advertisement. We do not provide your name, telephone number or e-mail address to these platforms for this purpose.

5. Purposes of processing

We process the information described above for the following purposes: (a) to respond to your enquiries and communicate with you; (b) to prepare and send quotations, process orders and arrange delivery; (c) to assign your enquiry to an appropriate member of our sales team; (d) to maintain records of our communications and transactions for business, accounting and legal purposes; (e) to understand how visitors use the Website, to identify pages, features or steps that cause difficulty, and to improve the design, content and performance of the Website; (f) to measure and improve the effectiveness of our advertising; (g) to detect, prevent and investigate spam, fraud, abuse and security incidents; and (h) to comply with applicable laws, regulations and requests from authorities.

6. Disclosure of personal data

We do not sell your personal data. We may disclose your personal data to: (a) our employees and sales staff who need it to serve you; (b) our related companies, branches, resellers and logistics providers, to the extent necessary to fulfil your enquiry or order; (c) service providers who host, operate or support the Website and our systems, including the third-party services described in Section 4, who process information on our behalf or for the purposes stated; (d) professional advisers such as auditors and lawyers; and (e) government agencies, courts or regulators where required or permitted by law.

7. Transfer outside Malaysia

Some of our service providers, including those listed in Section 4, store or process information on servers located outside Malaysia. By using the Website, you consent to the transfer of your information to such locations, which may not offer the same level of protection as Malaysia. Where we transfer personal data outside Malaysia, we take reasonable steps to ensure that it remains protected in a manner consistent with the PDPA.

8. Cookies and your choices

You may set your browser to refuse or delete cookies, or to alert you when cookies are being sent. The Website will continue to function if cookies are disabled, although some measurements may be less accurate. You may also manage advertising preferences through the settings of the relevant advertising platforms.

9. Retention

Website usage records held on our own systems are automatically deleted after ninety (90) days. Enquiry and customer records are retained for as long as necessary to fulfil the purposes stated in this Privacy Notice, including for business, accounting, tax and legal requirements, after which they are deleted or anonymised. Information held by third-party services is retained in accordance with their respective policies.

10. Security

We take reasonable practical steps to protect personal data from loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction, including restricting access to our customer records to authorised staff. However, no method of transmission over the internet or of electronic storage is completely secure, and we cannot guarantee absolute security.

11. Limitation of liability

To the fullest extent permitted by law, Federlite Sdn Bhd, the Felton brand, and their related companies, directors, officers, employees and agents shall not be liable for any direct, indirect, incidental, special or consequential loss or damage arising from or in connection with: (a) any unauthorised access to, or interception, loss or alteration of, information transmitted to or through the Website, where such event is beyond our reasonable control; (b) the acts, omissions, practices or policies of any third-party service, platform or website, including those listed in Section 4 and WhatsApp; (c) any inaccurate, incomplete or misleading information provided by you; or (d) any interruption, error or unavailability of the Website. Nothing in this Privacy Notice excludes any liability which cannot be excluded under applicable law.

12. Third-party websites and platforms

The Website contains links to, and buttons that open, third-party websites and applications, including WhatsApp, Instagram, Facebook and TikTok. Once you leave the Website or open such an application, your use is governed by the terms and privacy policy of that third party, and we are not responsible for their content, security or practices.

13. Your rights

Subject to the PDPA, you have the right to request access to, and correction of, the personal data we hold about you, to withdraw your consent to the processing of your personal data, and to limit the processing of your personal data, including for direct marketing. Requests should be made in writing to the contact details in Section 16. We may refuse a request where permitted under the PDPA, including where compliance would disclose the personal data of another person or where the request is frivolous or vexatious. We may charge a fee permitted by law for processing a data access request, and we may need to verify your identity before acting on any request. Withdrawal of consent may affect our ability to respond to you or supply products to you.

14. Children

The Website is intended for businesses and adult consumers. We do not knowingly collect personal data from persons under the age of eighteen (18) without the consent of a parent or guardian.

15. Changes to this Privacy Notice

We may amend this Privacy Notice from time to time. The updated version will be published on this page with a revised "Last updated" date, and will take effect from the date of publication. Your continued use of the Website after any amendment constitutes your acceptance of the amended Privacy Notice.

17. Language

This Privacy Notice is published in English. In the event of any inconsistency between this version and any translation, the English version shall prevail.

18. Governing law

This Privacy Notice is governed by the laws of Malaysia, and any dispute arising from it shall be subject to the exclusive jurisdiction of the courts of Malaysia.
